The Legal Exchange

The Legal Exchange – a new source of work for family lawyers.

The Legal Exchange

Background

Direct Mediation Services (DMS) works with families in conflict. As part of our Mediation Information & Assessment Meeting (MIAM) we talk to our clients about the benefits of legal advice. We also ask them directly if they have legal representation. Many times, we find mediation clients are lost within the legal process and would benefit from some legal advice. They are asked if they would like to be put in contact with a family lawyer, and if the answer is yes, we ask if they would like to release their MIAM form (without their ex-partner’s details) in order to save time for everyone involved.

  • 1. Mediation Client attends MIAM.
  • 2. Client requests to be put in contact with an independent family lawyer.
  • 3. Client gives permission for MIAM form to be release (without ex-partner’s details).
  • 4. Summary of case details are put on the WhatsApp group. This excludes client’s name, but includes location.
  • 5. Lawyers receive message on WhatsApp and respond with “Yes” if they are interested and the details are sent to them by DMS. This is on a first come first served service.
  • 6. Three working days later, DMS staff contact client to see if they have engaged with the family lawyer, who asked for the work.
  • 7. If not, and the client still wants legal advice, the work will be advertised again on the WhatsApp group.
  • 8. All we ask is for lawyers to pay 15% of professional fees received to DMS on completion of the case.
